This website provides information for the proposed Hepatitis C Drug class action settlement (“Settlement”) in Jones, et al. v. United HealthCare Services, Inc., et al., No. 15-cv-61144 (S.D. Fla.) (the “Action”). The Action concerns the denial of prior authorization for prescription drugs used to treat the Hepatitis C virus for certain individuals with a medical benefit or prescription drug benefit (or both) insured or administered by the United Defendants in the Action. The Settlement would resolve all past and future claims for injunctive, declaratory, or monetary relief against United HealthCare Services, Inc., its direct and indirect corporate parents, subsidiaries, and affiliates, and the customers of any or all of those entities (collectively, “United”), that are in any way related to the Action, Hepatitis C Drugs, or Hepatitis C.
Your rights and options—including the deadlines to exercise them—are explained on this website. Please read this website carefully. Capitalized terms on this website have the same meaning as provided in the Settlement Agreement on file with the Court.
|YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT:|
|DO NOTHING||If you do nothing, you will be bound by the Settlement and its benefits, if it is approved by the Court. YOU WILL BE PRECLUDED FROM PURSUING ANY CLAIM FOR DAMAGES AGAINST UNITED.|
|OPT OUT AND EXCLUDE YOURSELF||Write to the Settlement Administrator if you do not want to be bound by the Settlement as to monetary relief. YOU WILL NOT BE PRECLUDED FROM PURSUING A CLAIM FOR DAMAGES AGAINST UNITED.|
|OBJECT||File an objection with the Court if you are not satisfied with the Settlement. FILING AN OBJECTION DOES NOT EXCLUDE YOU FROM THE SETTLEMENT.|
|GO TO A HEARING||If you file an objection, you may ask for permission to speak in Court about the fairness of the Settlement.|
